**Team Description **(Overview of the team)**
The Brussels Legal team supports the activities of the European bank of the BNY Mellon group which is incorporated in Belgium and operates branches in Frankfurt, Amsterdam, Dublin, Luxembourg, Milan, Paris, Madrid and Copenhagen (the “European Bank”).
The European Bank is authorised and regulated by the European Central Bank and the National Bank of Belgium as a significant credit institution under the Single Supervisory Mechanism and is licensed as a Belgian custodian bank. It is also supervised by the Belgian Financial Services and Markets Authority.
The core business of the European Bank is asset servicing (custody, depositary, fund administration) but it also offers other investment services products (collateral management, clearance, securities finance, FX and liquidity services) as well as corporate trust services.
The team provides legal advice on a wide range of financial matters: custody, other financial transactions (derivatives, security interests, etc), banking regulation (including ESG, digital assets, outsourcing, and recovery and resolution) as well as corporate restructuring.
The Brussels Legal team is part of the Europe, Middle East and Africa (EMEA) Legal department and works closely with colleagues across the region, in particular with specialised teams in London including experts for each line of business, for regulation and supervision, and for other matters such as M&A, litigation, IP/IT, etc. The team also liaises with colleagues in the United States and the Asia/Pacific region.
Currently, the Legal department in Brussels includes 5 lawyers, 2 public policy advisors, 1 paralegal and 3 assistants.
**Job Purpose **(What the job role involves)**
Your role will be to provide legal advice and support to the European Bank, in particular in relation to banking and Asset Servicing & Digital (ASD) business, and with a secondary focus on Clearance, Collateral Management (CCM), Liquidity and Securities Finance (Markets). You will negotiate contracts with clients and advise the business on applicable law and regulation in relation to the activities of the bank and on the implementation of new services and products.
You will mainly support our Belgian business and will work closely with our colleagues in the Netherlands and Luxembourg in case additional support is required in those locations.
You will work with other lawyers in the EMEA Legal department to deliver a high standard of legal advice that is tailored to BNY Mellon’s business model.
**Responsibilities **(Key parts to the job role)**
- Follow developments and advise business and management on banking and financial law/regulation mainly in relation to asset servicing and safety (Banking Law, Law of 2 August 2002, Royal Decree n°62, Financial Collateral Law as well as MiFID II, AIFMD, UCITS V, CSDR, AML, etc.);
- Advise/support the business in developing and implementing services and products in line with applicable law & regulation;
- Support the development and advise on ASD activities and asset safety (custody, depositary services);
- Support the EMEA CCM and Markets Legal teams with advice on the Belgian law aspects of these businesses (asset safety, security interests, general contract law);
- Draft, review and/or negotiate contracts with clients (mainly custody services);
- Support strategic business initiatives in providing effective and timely legal advice and in drafting any legal documentation ;
- Advise and prepare documentation in relation to internal and external outsourcing;
- Advise generally on a wide range of commercial matters;
- Support knowledge sharing within the legal team.

**Requirements **(what we are looking for)**
- License/Master's degree in Belgian, Dutch or Luxembourg law, a post-graduate degree would be a plus;
- Working knowledge in EU and Belgian banking and financial law and regulation;
- Familiarity with current legal, regulatory and market trends and initiatives in Europe and in Belgium; and
- Fluent in English and in French or Dutch (written & oral).
